Terms and Conditions
This is a courtesy translation. Only the German version is legally binding.
§ 1 Scope, definitions
(1) The following General Terms and Conditions apply to all orders placed through our online shop between us and consumers, in the version valid at the time of the order.
(2) A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity (Section 13 of the German Civil Code, BGB). An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity (Section 14 BGB).
§ 2 Contracting party, conclusion of contract
(1) The purchase contract is concluded with Al-Hanaa Rösterei, owner Walid Kurhabi, Hauptstraße 130-134 / Haus 12, 04416 Markkleeberg, Germany (sole proprietorship), hereinafter “we” or “the seller”.
(2) The presentation of products in our online shop is not a legally binding offer on our part but a non-binding invitation to the consumer to order goods. By submitting the order, the consumer makes a binding offer to conclude a purchase contract.
(3) The order is placed in the following steps:
- selecting the desired goods and variant in the online shop,
- adding the goods to the shopping cart,
- opening the checkout and reviewing the details in the shopping cart,
- entering the delivery and contact details or choosing pickup,
- choosing the payment method,
- binding submission of the order by clicking the button “Zahlungspflichtig bestellen” (order with obligation to pay) or, when paying through a payment service provider (PayPal, Stripe), by clicking the correspondingly labelled button of the selected payment service provider.
Depending on the payment method chosen, the binding order is therefore placed either by clicking the button “Zahlungspflichtig bestellen” (bank transfer in advance, cash on pickup) or by clicking the button of the selected payment service provider (PayPal, Stripe), each of which makes unmistakably clear that the order entails an obligation to pay.
Before submitting the order, the consumer can review and correct their details at any time by going back within the ordering process, or cancel the ordering process by closing the browser window. We confirm receipt of the order by email without undue delay (when paying through PayPal or Stripe, as soon as payment has reached us). This order confirmation does not yet constitute acceptance of the offer unless we expressly declare acceptance in it.
(4) We store the order data. After the order has been completed we send the consumer an order confirmation by email; the General Terms and Conditions, the withdrawal notice and the model withdrawal form are attached to it as PDF files. The General Terms and Conditions can also be viewed at any time on this page. We do not offer a customer account through which order data can be retrieved.
(5) The contract language is German. Where we additionally offer the ordering process, emails or documents in English, this is for information only; the German version is always the binding one.
§ 3 Prices, shipping costs, payment
(1) The prices shown on the product pages are total prices. They include the applicable statutory value added tax and other price components. Any shipping costs are added; they are communicated on the product page and, at the latest, on the order page before the order is submitted.
(2) For goods sold by weight we additionally state the base price per kilogram in accordance with the German Price Indication Ordinance.
(3) Details on shipping costs, free shipping above a certain order value, pickup at our business premises and delivery times are summarised on the page Shipping and payment.
(4) The following payment methods are available to the consumer: credit card, Apple Pay and Google Pay through the payment service provider Stripe, payment through PayPal, bank transfer in advance (Vorkasse) and, when collecting at our business premises in Markkleeberg, cash on pickup.
(5) When paying by bank transfer in advance, the consumer undertakes to transfer the purchase price without undue delay after conclusion of the contract. With this payment method the ordered goods are reserved for the consumer for the period stated at the time of the order and in the order confirmation; if payment has not reached us within this period, we are entitled to withdraw from the contract and to put the goods back on sale.
(6) Cash on pickup is only possible when the goods are collected at our business premises in Markkleeberg. The consumer pays the purchase price in cash on handover of the goods. With this payment method the ordered goods are held for collection for the period stated at the time of the order and in the order confirmation; if the goods are not collected within this period, we are entitled to withdraw from the contract, to cancel the order and to put the goods back on sale.
(7) Payments through PayPal and Stripe are processed exclusively through the hosted payment forms of the respective payment service providers. Payment card data is never transmitted to us or stored by us. For details see our privacy policy.
(8) We issue an invoice on request and send it by email as a PDF file. To request one, please contact us at info@alhanaa.de, stating the order number.
§ 4 Delivery and pickup
(1) Delivery is made within Germany. The expected delivery time is stated on the product page, in the shopping cart and on the page Shipping and payment.
(2) As an alternative to shipping, the goods can be collected free of charge at our business premises in Markkleeberg. Collection requires a prior order; as soon as the order is ready for collection, we inform the consumer by email. When collecting, payment is possible in advance by PayPal or bank transfer, or in cash on pickup. The pickup address and pickup times are communicated on the order page and in the order confirmation.
(3) In a consumer goods sale involving shipment to the consumer, the risk of accidental loss and accidental deterioration of the goods sold passes to the consumer only upon handover of the goods to the consumer, even if the shipment is insured.
(4) Should an ordered item be unavailable despite careful stock-keeping, we will inform the consumer without undue delay. Payments already made will in this case be refunded without undue delay.
§ 5 Retention of title
The goods remain our property until the purchase price has been paid in full.
§ 6 Right of withdrawal
(1) Consumers have a right of withdrawal in accordance with the statutory provisions. Details are set out in our withdrawal notice, which is additionally sent to the consumer, together with the model withdrawal form, as a PDF file with the order confirmation.
(2) The right of withdrawal can also be exercised online through our withdrawal function at https://www.alhanaa.de/en/withdraw-from-contract/.
(3) We grant the right of withdrawal also for goods delivered in sealed packaging. We do not invoke the exception for sealed goods that are unsuitable for return for reasons of health protection or hygiene (Section 312g (2) no. 3 BGB).
§ 7 Liability for defects
(1) The statutory provisions on liability for defects apply (Sections 434 et seq. BGB).
(2) The goods we sell are foodstuffs. The best-before date is stated on the packaging. The consumer is asked to inspect the goods on receipt to the usual extent for transport damage and obvious defects and to report these to us at the email address given in our imprint. Failure to give such notice does not affect the consumer’s statutory warranty rights.
(3) Information on ingredients and allergens in accordance with the Food Information Regulation (LMIV) is given on the respective product page.
§ 8 Liability
(1) We are liable without limitation for damages resulting from injury to life, body or health that are based on a negligent or intentional breach of duty by us or one of our vicarious agents, and for damages covered by the Product Liability Act.
(2) For other damages based on simple negligence, we are liable only where the negligence concerns the breach of an essential contractual obligation, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose observance the consumer may rely. In this case liability is limited to the foreseeable damage typical for this type of contract.
(3) The above limitations of liability do not affect the consumer’s claims under product liability law.
§ 9 Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final provisions
(1) The law of the Federal Republic of Germany applies to contracts between us and consumers, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as this does not remove mandatory consumer protection provisions of the state in which the consumer has their habitual residence.
(2) Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions remains unaffected.
